Viscount submitted on his knees to the Earl of Essex (Fiant No 6309)
Thomas is named as living in Jan 1600/1 ‘married
a daughter of a gentleman of Lord Power his house by whom he hath divers sons
and daughters (SPI Eliz. Vol 208 no 26)
Thomas was pardoned 3 Dec 1605 as Thomas
Butler of Cowlenclyne Co Kilkenny (Cal Pat Rolls 3 Jas I)
Thomas Butler died before the year 1612.
He married
Ellen daughter of Pierce Power of Rathcomack Co Waterford 2nd son of
Sir John 2nd Lord Power of Curraghmore Co Waterford. She was
pardoned with her husband 15 Aug 1599 (Fiant 6309).
She survived him and was living 25 July 1614
when she held one third of Castlecomer, Turrinaspug Co Kilkenny as her dower.
(Inq. XXXVII Co Kk.)
According to SPI Jane 1600/1 they had divers
sons and daughters.
Rothe’s Register gives Tomas 4th
son of Richard 1st Visc. Mountgarrett had issue Pierce and other children and he is called ‘of Castlecomer’
(TCD F. 3. 16 No. 13)
Both Carew 626 and 635 give a Power marriage,
the latter making her the daughter of Thomas Power of Cullefin Co Waterford and
gives details of their issue which I was not able to decipher. I only know of
one child.
Pierce
Butler of Castlecomer who died 25 July 1614; the
inquisition on his death at Thomastown Co Kk on 4 June 1623 is numbered XXXVII
and is printed in full in Healy’s Kilkenny p407/8
It finds that he held at the time of his
death Turnipaspug and Ballilonan of the Earl of Desmond as of his manor of
Dromore and Castlecomer from the King in capita and that he was seized in fee
of Cowlenclyne held from the Earl of Desmond and that in 1612 he mortgaged the
same to Edmond Tobin fitzWalter for ₤60 subject to redemption.
On 25 March Richard Butler of Cowlenclyne Co Kk was on of the feoffees in a
settlement made by Edmond Baron als FiztGerald of Brownsford. This settlement
was confirmed by Edmond Baron on 16 Feb 1607 when Richard was again one of the
feoffees (Inq Co Kk XXXV Healy p404). This Richard
may have been the elder brother. If the elder brother, he probably died before
6 Dec 1607, when Peter Butler of Cowleclyne Co Kk had a general Pardon (Cal
Par Rolls 5 James I)
Pierce
Butler died 25 July 1614 leaving Ellice Bowen/Barron his widow (Inq
XXXVII) but from the tenor of the Inquisition XXXV it seems that this Ellice
was the daughter of David fitzGerald als Barron of Brownsford and that she
subsequently married Patrick Forstall of Ballyfrunke Co Kikenny.
He had issue:
a son and heir Richard who was nine years old when his father died; 2nd son Thomas
17 Jan 1632 Richard Butler mortgaged Castlecomer to Thomas Ridgeway Earl of
Londonderry (Inq Co Kilkenny 17 Jan 1632 the mortgage would be before this
date.)
1616: He should be the person named in Rothes
Register but his father is named having died in 1614.
Richard is not shown as the Proprietor of the
family property in 1641- the Book of Survey and Distribution being confused on
this point. He was nevertheless living at Castlecomer at this time and took an
active part in the revolt of the Irish. From the deposition of Richard Hudson
TCD MSS No CLXXVI we learn that he and his brother Thomas were living at
Castlecomer and that the latter was made Captain of the town and castle and
that in the second week of Lent 1642 the said Thomas took certain prisoners to
Kilkenny and hanged them there (Hickson Vol 2 p89). It is probable that Richard
and Thomas his brother were active during the rebellion in the Queens Co
(Depositions Queens Co TCD Vol 7; TCD
F.2.8.p110)
25 Dec 1652: Attestation of William Roth of
Inchikilly ‘I had no other refuge but to be with the lady of Ormond at the
castle of Kilkenny who sent me to the Castle Comer to Richard Butler who was
the governor there to send Mr Wandesford (POR 1614? Bk of Survey etc) and all the
English that were there, unto her to protect them’.
HMC Cal OD Vol 2 p370 NS
Richard
Butler had issue:
1. James of Castlecomer
who served in the Army of Westphalia. He was adjutant in the Prince of Muster’s
Army in 1666. He was appointed Governor of Thefeght in 1666/7 (Ormond MSS NS
Vol 3 p359 etc) Administration of his estate was granted to his daughter
Elizabeth 16 March 1686 (Butler will No 375)
2. Richard Butler of
Castlecomer Co Kilkenny who died intestate and
administration of his good were granted to his niece Elizabeth Butler widow 22
May 1689 (Butler Will no 460)
Elizabeth
daughter of James Butler above who was administrix
of her father and uncle was a widow in 1689 but of whom no facts have been
found.
James
Butler, and Theobald Butler, 5th and 6th sons of Sir Richard
Butler
Note these 2 sons will be found in Carew 626
p136 and 635 p27. They are not mentioned in any other pedigree either MSS or
printed that I have seen (T Blake Butler 7 Dec 1956)
James
Butler:
James Butler who took part in the ‘Butler
Wars’ and was present at the raid on Enniscorthy with Sir Edmond Butler in
August 1569. For his part in this rebellion he was outlawed and attainted by
Act of Parliament in June 1570 and all his estate was forfeited (Statutes at
Large Ire Vol. i)
The Queen stayed the execution of this Act in
June-July 1570 and he was pardoned 2 Jan 1571 and fined 100/- (Fiant No 1946)
He may be identical with James Butler of
Ballymore (Parish of Templeshan and Kilbride) Co Wexford who had a pardon 13
July 1571/2 (Morrin Vol 2 p16)
He appears to have died without issue before
Jan 1600/1 (SPI Eliza Vol 208 No 26)
James his lands as James fitzRichard valued
at ₤13.13.4 in Co Kilkenny in 1670 Carew Papers Vol. 611 p87
Theobald
Butler:
Theobald Butler who according to Carew 635
p27 died s.p.
He is also named in the Ormond Pedigree
compiled by the Rev. John Butler of Northhampton (Carte Vol 69 p557) but this
is confused and unreliable.
18 Feb 1616: Pardon to James Butler
fitzTheobald of Kileyny Co Wexford (Cal Pat Rolls Jas I, 15th year)
??? not identified.
As neither James or Theobald are included in
the pardon of 15 Aug 1599 which embraced the whole of Mountgarret’s family,
they were probably then dead. (Fiant No 6309) ___?
However, Fiant 6309 15 Aug 1599: Pardon to
John Butler fitzJames and Margaret Nugent his wife, William and Walter Butler
fitzTheobald.
