Research by the late Theobald Blake Butler: Genealogy of the Butlers,-Volume 8, Viscount Mountgarrett and Poolestown, Bart, Chapter- Butler, Viscount Mountgarrett & Colaterals Ormond Deeds and Letters (no page numbers);filmed by the Genealogical Society of Utah (LDS) FHL British Film [873840].

James Butler of Dowganstown, Parish of Clodagh Co. Carlow, and Tullow als Tullophelin in the Parish of same Barony of Rathvilly Co Carlow.

James Butler, 2nd son of Pierce Butler of Kayer, Co Wexford, and Margaret Devereux, was in all probability of age when his father died in 1599 (his elder brother Edward then being 22. viz. born 1577) (Inquisition Co Wexford No 18 Jas I)

Philip O’Kennedy of Clonbreakane Co Tipperary Gent.
About 25 years ago Suplt being in quiet possession of the lands (part) Co Tipperary owing to late wars Suplt was forced to lease premises. Writing which could prove the justice of Suplts claim is in possession of James Butler of Moneyhore Co Wexford who has made fraudulent conveyance of the premises and Suplt has no power to redress Butlers alliance in the said county being so great (See also Book of Civil Survey Co Tipp. Parish of Tirreglasse Barony of Lower Ormond)

They had issue- five sons and two daughters Viz:

8. Possible son- James Butler- see below

Edward Butler the eldest son was aged 21 when his father died (Inq Co Catherlagh No 24 Chas I) in 10 Feb 1629.

14 June 1632 He had livery of his estates as Edward son and heir of James Butler late of Tullow Co Carlow deceased (Morris Vol 3 p602)

10 Aug 1638. Grant to Edward Butler of the lands etc. Of Dowganstown, Darryroe (?Garrryroe?) & Skeaghbennt in the county of Carlow at a chief rent of 7/6 per ann. (Lodge Register Vol 1 Chas II p105)

24 Feb 1640 Edward brought an action against his mother Ellen Butler  for possession of the title deeds and feoffment of Tullaghphelim, Rathlaghan,  Dawnyus, & Ballybreeken Co Carlow which formed part of  his marriage settlement of 5 June 1626 and which he claimed that she and his brother Walter withheld from him (Chancery Bill).

According to the extracts from the will of his father Edward was named as executor but this he denies in the above bill and says that his mother and brother Walter were executors (Butler Will No 196 & CB)

Edward died before 23 Oct 1641 when his son and heir James is shown as proprietor of the family estates (Civil Survey and Book of Survey and Distribution for Carlow and Tipperary)

29 July 1641 Edward Butler, now High Sheriff of the County Carlow (Ryan’s History of Co Carlow p.162). If this is our Edward then he died July-October 1641.

Edward married MS 5 June 1626 Gennett daughter of Oliver or Glyter Eustace of Ballymoney Co Carlow and Ballygriffen Co Dublin (CB 24 Feb 1640 & OD[Ormond deeds] No. 3692)

From this point TBB follows Gen Office Pedigree, Vol. 27, P.276/7 which is printed in Misc. Her. And Gen. 3rd Series Vol. 5 p. 115/6. In neither case are any authorities given.

James Butler the eldest son of Edward Butler, was Proprietor in Oct 1642 of Dowganstown and Newgadden, Parish of Clodagh, Barony of Catherlagh, 271 acres this property was granted to Richard Andrews for Peregrine Pretty (Bk of Survey etc), and of N(?K)eivyre 241 acres and Rorane 25 acres which were granted to the Earl of Cork. These last tow in the parish of Tirraglass Barony of Lower Ormond 9Bk of Survey)

James forfeited his estates under the English Act of Parliament of 11 Oct 1652 for rebellion.

Sept 1653 to July 1654 he had a tranplanter’s certificate from the precincts.

Dec 1641- According to the Deposition of Ralph Buckley of Carlow James Butler of tullow Esq. and most of the Irish Gentry joined the rebellion but as he was only at most 16 years old at that time this seems unlikely (Deposition Co Carlow No CLXXII Hickson Vol. 2 p79)

James Butler of Tullogh Co Carlow had no certificate from the Athlone & Loughrea Commissioners. But Ormond MSS Vol. 2 p.125 gives the following:
Thomas Bagnall and Jane his wife and Nicholas Bagnall an natural idiot and brother of the said Thomas Bagnall of Donganstown Co Catherlough Decree 1 April 1656. Final Settlement 19 Aug 1656 378 acres.
? Was the above Jane Bagnall the daughter and heir of James Butler of Dowganstown (see BTR 70 and 242)
(Editor’s note- Thomas and Jane Bagnall’s daughter Jane married Edward Butler of Moneyhore Co Wexford, son of Pierce Butler of Kayer- see BTR 70)

The next and last notice found on the Dowganstown family is in the forfeitures of 1691 for rebellion as at 21 June 1688. Edward Butler of Dowganstown Co Carlow, but no claim appears to have been made against his estate at Chichester House in 1700.

Returning to Gen Office Pedigree Vol 27 p276/7 which was registered at the old Office of arms by the late G.D. Burtcheall 24 April 1902, this reads as follows (omitting the early part):
Edward eldest son of James (ob. 10 Feb 1629) was of Tullow Co Carlow, born 1618. High Sheriff of Co Carlow 1641. Jan Butler (d. 1828) of Poland.

Clues- He m. Antoinette Foszez (d. 23 July 1823). He d. 26 Feb. 1828, in Livonia at Zakrzewszczyzna where his son, Vincent had been born, 9 Oct. 1810 (per M. Junqua of Paris).

136. BJ2#1 Jan Butler (d.1828) of Poland

The best known Irish Butler in Poland was Col. James Butler (d.1634) who was probably a son of James (d.1629) of Dowganstown, Co. Carlow, 2nd. s/o Pierce, 2nd. s/o Richard, 1st. Viscount Mountgarret. Col. James was created a Count of the Empire in 1627 and eventually settled in Poland with his wife and children. From, him are believed to descend Joseph and Antoine Butler, both of whom, in 1824, had their titles confirmed as Counts of Poland.

Colonel James Butler, possibly a son of James Butler of Dowganstown, was in Polish service against Russia in 1617-18. In 1619, he travelled back to Ireland to recruit men and brought back 300 men to Poland. They fought against Swedish forces in 1622 in Livonia. In 1625 he commanded a 400-men regiment of dragoons in the Polish Quarter Army fighting against the Cossacks. He had his noble status confirmed in Poland-Lithuania in 1627, and fought in campaigns against the Swedes in Prussia in 1626-29. By 1630 he was recruiting troops for the Imperial Service and served with his kinsman Colonel Walter Butler of Paulstown (the Wallenstein assassination incident in 1634). He returned from Imperial service in 1633 and led a 1000 strong regiment of infantry against the Muscovites and was highly praised for his valour in the 1633-34 campaign. It is uncertain what happened to him after this, but his descendants continue to live in Poland.

Dowganstown, or Dunganstown, now Bestfield north of Carlow city on the banks of the Barrow- see the Down's/Petty Survey map of 1659- Ducanstowne.

15 Aug 1599 Pardon to Thomas Butler and Ellen Power his wife. With the rest of the Mountgarrets when Edmond the 2nd Viscount submitted on his knees to the Earl of Essex (Fiant No 6309)

Thomas is named as living in Jan 1600/1 ‘married a daughter of a gentleman of Lord Power his house by whom he hath divers sons and daughters (SPI Eliz. Vol 208 no 26)

Thomas was pardoned 3 Dec 1605 as Thomas Butler of Cowlenclyne Co Kilkenny (Cal Pat Rolls 3 Jas I)

Thomas Butler died before the year 1612.

He married Ellen daughter of Pierce Power of Rathcomack Co Waterford 2nd son of Sir John 2nd Lord Power of Curraghmore Co Waterford. She was pardoned with her husband 15 Aug 1599 (Fiant 6309).
She survived him and was living 25 July 1614 when she held one third of Castlecomer, Turrinaspug Co Kilkenny as her dower. (Inq. XXXVII Co Kk.)

According to SPI Jane 1600/1 they had divers sons and daughters.
Rothe’s Register gives Tomas 4th son of Richard 1st Visc. Mountgarrett had issue Pierce and other children and he is called ‘of Castlecomer’ (TCD F. 3. 16 No. 13)
Both Carew 626 and 635 give a Power marriage, the latter making her the daughter of Thomas Power of Cullefin Co Waterford and gives details of their issue which I was not able to decipher. I only know of one child.

Pierce Butler of Castlecomer who died 25 July 1614; the inquisition on his death at Thomastown Co Kk on 4 June 1623 is numbered XXXVII and is printed in full in Healy’s Kilkenny p407/8
It finds that he held at the time of his death Turnipaspug and Ballilonan of the Earl of Desmond as of his manor of Dromore and Castlecomer from the King in capita and that he was seized in fee of Cowlenclyne held from the Earl of Desmond and that in 1612 he mortgaged the same to Edmond Tobin fitzWalter for ₤60 subject to redemption.

On 25 March Richard Butler of Cowlenclyne Co Kk was on of the feoffees in a settlement made by Edmond Baron als FiztGerald of Brownsford. This settlement was confirmed by Edmond Baron on 16 Feb 1607 when Richard was again one of the feoffees (Inq Co Kk XXXV Healy p404). This Richard may have been the elder brother. If the elder brother, he probably died before 6 Dec 1607, when Peter Butler of Cowleclyne Co Kk had a general Pardon (Cal Par Rolls 5 James I)

Pierce Butler died 25 July 1614 leaving Ellice Bowen/Barron his widow (Inq XXXVII) but from the tenor of the Inquisition XXXV it seems that this Ellice was the daughter of David fitzGerald als Barron of Brownsford and that she subsequently married Patrick Forstall of Ballyfrunke Co Kikenny.
He had issue: a son and heir Richard who was nine years old when his father died; 2nd son Thomas
17 Jan 1632 Richard Butler mortgaged Castlecomer to Thomas Ridgeway Earl of Londonderry (Inq Co Kilkenny 17 Jan 1632 the mortgage would be before this date.)
1616: He should be the person named in Rothes Register but his father is named having died in 1614.
Richard is not shown as the Proprietor of the family property in 1641- the Book of Survey and Distribution being confused on this point. He was nevertheless living at Castlecomer at this time and took an active part in the revolt of the Irish. From the deposition of Richard Hudson TCD MSS No CLXXVI we learn that he and his brother Thomas were living at Castlecomer and that the latter was made Captain of the town and castle and that in the second week of Lent 1642 the said Thomas took certain prisoners to Kilkenny and hanged them there (Hickson Vol 2 p89). It is probable that Richard and Thomas his brother were active during the rebellion in the Queens Co (Depositions Queens Co TCD Vol 7;  TCD F.2.8.p110)
25 Dec 1652: Attestation of William Roth of Inchikilly ‘I had no other refuge but to be with the lady of Ormond at the castle of Kilkenny who sent me to the Castle Comer to Richard Butler who was the governor there to send Mr Wandesford (POR 1614? Bk of Survey etc) and all the English that were there, unto her to protect them’.
HMC Cal OD Vol 2 p370 NS
Richard Butler had issue:
1.    James of Castlecomer who served in the Army of Westphalia. He was adjutant in the Prince of Muster’s Army in 1666. He was appointed Governor of Thefeght in 1666/7 (Ormond MSS NS Vol 3 p359 etc) Administration of his estate was granted to his daughter Elizabeth 16 March 1686 (Butler will No 375)
2.    Richard Butler of Castlecomer Co Kilkenny who died intestate and administration of his good were granted to his niece Elizabeth Butler widow 22 May 1689 (Butler Will no 460)

Elizabeth daughter of James Butler above who was administrix of her father and uncle was a widow in 1689 but of whom no facts have been found.

James Butler, and Theobald Butler, 5th and 6th sons of Sir Richard Butler

Note these 2 sons will be found in Carew 626 p136 and 635 p27. They are not mentioned in any other pedigree either MSS or printed that I have seen (T Blake Butler 7 Dec 1956)

James Butler:

James Butler who took part in the ‘Butler Wars’ and was present at the raid on Enniscorthy with Sir Edmond Butler in August 1569. For his part in this rebellion he was outlawed and attainted by Act of Parliament in June 1570 and all his estate was forfeited (Statutes at Large Ire Vol. i)
The Queen stayed the execution of this Act in June-July 1570 and he was pardoned 2 Jan 1571 and fined 100/- (Fiant No 1946)

He may be identical with James Butler of Ballymore (Parish of Templeshan and Kilbride) Co Wexford who had a pardon 13 July 1571/2 (Morrin Vol 2 p16)

He appears to have died without issue before Jan 1600/1 (SPI Eliza Vol 208 No 26)

James his lands as James fitzRichard valued at ₤13.13.4 in Co Kilkenny in 1670 Carew Papers Vol. 611 p87

Theobald Butler:

Theobald Butler who according to Carew 635 p27 died s.p.

He is also named in the Ormond Pedigree compiled by the Rev. John Butler of Northhampton (Carte Vol 69 p557) but this is confused and unreliable.

18 Feb 1616: Pardon to James Butler fitzTheobald of Kileyny Co Wexford (Cal Pat Rolls Jas I, 15th year) ??? not identified.

As neither James or Theobald are included in the pardon of 15 Aug 1599 which embraced the whole of Mountgarret’s family, they were probably then dead. (Fiant No 6309) ___?

However, Fiant 6309 15 Aug 1599: Pardon to John Butler fitzJames and Margaret Nugent his wife, William and Walter Butler fitzTheobald.
